Antenatal follow ups by GP is allowed for up to 24 weeks. Beyond 24 weeks, GP must refer patient to specialist or GP with obstetrics for further care and management.

Will my premium increase over the coming years?

The MMI scheme is renewed annually, during which the performance of the portfolio is analyzed. Changes in premium is based on the respective specialty or professions performance over a period of years, if exposure or risk in relation to the specialty/profession seem to be increasing according to market trend and litigation quantum, Insurer will increase the premium or move the profession to a higher category of risk.

What is the available specialty for Dental?

Oral & Maxillofacial Surgery has been grouped under Medium Risk category.  General Dentistry includes Orthodontics, Endodontics, Pedodontics, Periodontics, Prosthodontics, Restorative and Special Needs.

Which are the practices recognized under Allied Health Practitioners (AHP)?

All 23 practitioners recognized under the ALLIED HEALTH PROFESSION ACT 2016. These professions are largely categorized into three groups:

1. Clinical (12 professions)

2. public health (four professions)

3. laboratory work (seven professions)

Presently, there are 23 job titles in the list of allied health professions that will be regulated under the AHPA. It includes:

• audiologists

• dietitians

• entomologists

• physiotherapists

• medical physicists

• nutritionists

What is covered under MMI?

The key protection is for claims brought against Insureds alleging negligence in the provision of medical malpractice. In such cases, MMI will cover the cost of appointing legal counsel to defend claims, the amount of any settlements, and court awards of judgments and costs. Does MMI extend to Malaysian Medical Council (MMC) Complaints?

Yes. Protection for the costs of dealing with any MMC complaints against you including legal representation at a Malaysian Medical Council Disciplinary Tribunal hearing arising from treatment provided by a doctor is included under MMI.

Can I choose my own lawyer?

Appointment of lawyer is subjected to insurer decision upon the reviewing of your case.
Our panel of lawyers are experts and have been handling Medical malpractice claims for many years. They were selected through a rigorous selection process, and the performance and capabilities of the lawyers on the list are reviewed on an annual basis.

What is risk mitigation? (Claim Mitigation action)?

Claim mitigation action is the process of identifying, evaluating and initiating the first step action as an effort to reach settlement of disputes.

How will notifying a claim or complaint impact my renewal?

Should you notify us on a claim or complaint that might likely to materialize, your next renewal status will be subjected to Insurer’s review.

What is Claims Made Basis?

MMI policy is on claims made basis, which means the policy triggered when a claim is first made against the insured during active policy period, regardless of the date of incident or when the wrongful/ negligent act occurred that gave rise to claim.

Given that the MMI policy also offers unlimited retroactive date, the policy will trigger for any unknown incident that may arise from the date you started practicing, provided that the incident is reported during active policy period.

The MMI policy also offers unlimited run off which means you are covered in the future for life even after you cease your operations or after your retirement. Subjected you have been continuously renewed with AON MMI for 5 consecutive years prior to retirement. Please contact Aon MMI service team to check on your eligibility of the run off cover.

What is the duration of the policy?

Usual policy duration is 12 months. In case you intend to purchase the policy for duration less than 12 months, this can be arranged under short term duration. However, for medical doctors it is advised to obtain policy effective 1^st Jan to 31^st Dec of the policy year to be in sync with MMC requirement for your APC renewal.

What if my place of practice is more than one and it differs from that declared in the proposal form, does the policy cover?

Yes. MMI policy covers Jurisdiction for Worldwide excluding USA and Canada, which means you can be practicing at more than one location.

Am I entitled for Telemedicine coverage despite it not being stated in the policy?

Yes, MMI policy extends cover to telemedicine. We do not limit the medium used by our Insureds to conduct their practice.
 

5.

Under what circumstance does the free locum cover trigger?

Insured’s policy under the locum cover will trigger once the Insured’s locum has exhausted his/her own medical indemnity policy. Please be reminded to check that your locum is registered with MMC and the APC is active.

How does the Aggravated Damages extension triggers based on three key factors of the MMI wording:

1. Full Retro Cover

2. Aggravated Damages inclusion into MMI: 1^st July 2018 at sub limit of RM500,000 in the aggregate and 1^st April 2019, sub limit revised to RM1,000,000 in the aggregate

3. Policy is based on Claims Made

Scenario A:
Date of Loss FIRST notified: prior to or at 30.6.2018 regardless of incident date (subjected to time bar period)
Aggravated Damages will not be extended

Scenario B:
Date of Loss FIRST notified: between 1.7.2018 to 31.3.2019 regardless of incident date (subjected to time bar period)
Aggravated Damages: extended at sublimit of RM500,000 in the aggregate
Full Retro Cover Applied on the Aggravated Damages extension

Scenario C:
Date of Loss FIRST notified: 1.4.2019 onwards regardless of incident date (subjected to time bar period)

Insured has been renewing with MMI for 5 consecutive years and retires at the sixth year. During retirement period, Insured is faced with a complaint or a possible claim over an incident that occurred during his/her practice when Insured was not covered under the MMI policy. Will the policy trigger based on unlimited run off and unlimited retroactive cover?

Yes the MMI policy will trigger provided Insured has been insuring with MMI for 5 consecutive years before retirement.

What Limits of Indemnity are available under this policy?

Limit of Indemnity varies with the respective profession covered under MMI policy. Please be informed premiums are charged based on the exposure associated with the profession/specialty.
